Section 445B.3647 - "Tier-2 thermal unit that emits mercury" defined

"Tier-2 thermal unit that emits mercury" means an existing thermal unit that emits mercury which:

1. Emits or has the potential to emit mercury at a level that is greater than de minimis mercury emissions; and

2. Is not a tier-1 thermal unit that emits mercury.
