Section 445A.Sec. 9 - NEWThe provisions of sections 3 to 19, inclusive do not apply to any activity which may result in the temporary or limited degradation of water quality if the Director determines that the activity is necessary:
1. To accommodate public health and safety in the area in which the surface water is located; or2. As an emergency response to mitigate an immediate threat to public health or safety. Any such activity must not be reoccurring and the Department shall ensure that any controls necessary are implemented to minimize the temporary impacts to water quality.Nev. Admin. Code § 445A.Sec. 9
