Section 439.862 - Confidentiality of records

The records of the Department relating to an applicant or enrollee are confidential and are considered protected health information under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 (HIPAA). Any use or release of protected health information must comply with the HIPAA Privacy Manual established by the Department, which reflects the provisions of Part 164 of Title 45 of the Code of Federal Regulations.
