As used in NRS 439.584, the Director will interpret the term "commercially available" to mean that information is available for a fee to any health care provider or other covered entity who is authorized to use a health information exchange pursuant to NAC 439.584, regardless of the relationship of the health care provider or other covered entity to other users of a health information exchange.
