Section 439.758 - "Hearing officer" defined"Hearing officer" means a person who:
1. Did not participate in the decision of the Department that is the subject of the hearing; and2. Is appointed by the Director of the Department or a designee thereof to preside at a hearing conducted pursuant to NAC 439.779 to 439.787, inclusive.Nev. Admin. Code § 439.758
