Section 436-2-200 - Role of Filing office

Unless otherwise expressly provided for by statute, the duties and responsibilities of the Filing office with respect to the administration of the UCC are ministerial. In accepting for filing or refusing to file a UCC record pursuant to these rules, the Filing office does none of the following:

200.1 Determine the legal sufficiency or insufficiency of the UCC record.
200.2 Determine that information in the UCC record is correct or incorrect, in whole or in part.
200.3 Create a presumption that information in the UCC record is correct or incorrect, in whole or in part.
