Section 370-700-702 - PRIZE POOL
702.01 Prize Pool

The prize pool for all prize categories shall consist of fifty percent (50%) of each drawing period's sales, including any specific statutorily-mandated tax of a selling lottery to be included in the price of a lottery ticket, after the prize reserve accounts are funded to the amounts set by the MUSL POWERBALL Product Group. Any amount remaining in the prize pool at the end of this game shall be returned to all lotteries participating in the reserve after the end of all claim periods of all selling lotteries, carried forward to a replacement game or expended in a manner as directed by the MUSL POWERBALL Product Group in accordance with applicable law.

702.02 Prize Reserve Accounts

Two percent (2%) of sales, including any specific statutorily-mandated tax to be included in the price of a lottery ticket, shall be placed in trust in one or more prize reserve accounts until the prize reserve accounts reach the amounts designated by the MUSL POWERBALL Product Group. Once the prize reserve accounts exceed the designated amounts, the excess shall become part of the prize pool. Any amount remaining in a prize reserve account at the end of this game shall be returned to all lotteries participating in the reserve after the end of all claim periods of all selling lotteries, carried forward to a replacement prize reserve account, or expended in a manner as directed by the MUSL POWERBALL Product Group in accordance with applicable law.

702.03 Expected Prize Payout Percentages

The Grand Prize shall be determined on a parimutuel basis. Except as otherwise mandated by law, executive order, or rule promulgated by an authority superior to the Nebraska Lottery or provided in these regulations, all other POWERBALL prizes awarded shall be paid as set cash prizes with the following expected prize payout percentages:

702.03A Prize money allocated to the Grand Prize category shall be divided equally by the number of game play areas winning the Grand Prize.
702.03B he prize pool percentage allocated to the POWERBALL set prizes (the cash prizes of $1,000,000 or less) shall be carried forward to subsequent draws if all or a portion of it is not needed to pay the POWERBALL set prizes awarded in the current draw. If the total of the POWERBALL set prizes awarded in a drawing exceeds the percentage of the prize pool allocated to the POWERBALL set prizes, then the amount needed to fund the POWERBALL set prizes awarded shall be drawn from the following sources, in the following order:
702.03B(1) The amount allocated to the POWERBALL set prizes and carried forward from previous draws, if any;
702.03B(2) An amount from the POWERBALL set prize reserve account, if available, not to exceed twenty-five million dollars ($25,000,000) per drawing. If, after these sources are depleted, there are not sufficient funds to pay the POWERBALL set prizes awarded, then the highest POWERBALL set prize shall become a parimutuel prize. If the amount of the highest POWERBALL set prize, when paid on a parimutuel basis, drops to or below the next highest POWERBALL set prize and there are still not sufficient funds to pay the remaining POWERBALL set prizes awarded, then the next highest POWERBALL set prize shall become a parimutuel prize. This procedure shall continue down through all POWERBALL set prize levels, if necessary, until all POWERBALL set prize levels become parimutuel prize levels. In that instance, the money available from the funding sources listed in this rule shall be divided among the winning plays in proportion to their respective prize percentages.
