Section 285-2-005
(1) No latter than six months after substantial completion of a Power Review Board approved facility the petitioner shall file a completion statement; substantial completion occurs upon commercial operation of the facility. The completion statement shall include
(a) the PRB application number;
(b) the estimated total cost and estimated date of completion as stated in the application; and
(c) the date of substantial completion/commercial operation and the actual total cost (as estimated on the date of filing the completion statement). If the completion statement reveals a significant divergence between the estimated total cost and the actual total cost, then the completion statement also shall include a full explanation of the significant divergence. Significant divergence shall mean a cost overrun of $150,000 on a facility with an estimated total cost of less than $1,000,000; and shall mean a cost overrun of 15% or more on a facility with an estimated total cost of $1,000,000 or more. The Board may hold an informational hearing on the cost overrun.
(2) In the event that a supplier terminates construction or acquisition of an electric generation or transmission facility after receiving approval for the facilities from the Nebraska Power Review Board, the supplier shall file with the Board within 30 days of the action taken to terminate construction or acquisition, a statement of the factors or reasons relied upon by the supplier for taking such action,
(3) If a transmission or distribution line project is not completed within the approximate time stated in the application, the supplier shall file with the Board a statement informing the Board why such project has not been completed in the time stated in the application.
