Section 230-6-007 - OSHA/MSHA standards as a referenceA. The Department is NOT an OSHA or MSHA enforcement authority, however, Neb. Rev. Stat. ' 48-443, et seq. requires review, determination and enforcement of safety issues. For that reason, OSHA standards and MSHA standards shall be considered in determining minimum acceptable standards.B. The Department shall use as a standard reference the Occupational Safety and Health Act (OSHA) of 1970, and the Mine Safety and Health Act (MSHA) of 1977, as cited in the definition of "Act" at &001(C)(4).
