Section 200-1-011 - Remedial actionThe department may deny or reduce as much as one hundred percent (100%) a reimbursement for costs of a remedial action for failure by the responsible person to comply with applicable statutory or regulatory requirements, including the provisions of these regulations.
011.01 Noncompliance issues for which the department will consider reimbursement reductions may include, but are not limited to, any of the following;011.01A Tank permit and registration requirements. 011.01B Tank design, construction, installation, and repair.011.01C Release detection requirements.011.01D Tank gauging requirements011.01E Release notification requirements.011.01F Release containment.011.01G Failure to clean up past spills and overfills when they occurred.011.01H Compliance with department standards of quality and performance, with department timetables, and with other applicable regulations.011.01I Disposal of wastes. 011.01J Operator training-Oil.011.01K Product compatibility.011.02 The responsible person will be responsible for the amount of any reductions.200 Neb.
