Section 93-8-001 - Exempt and Nonexempt Defined001.01 Exempt employees means employees who, by virtue of their primary duties and responsibilities, are professional, executive and/or administrative under the provisions of the federal Fair Labor Standards Act (FLSA) and are thereby exempt from overtime compensation payment and/or time off in lieu of such payment.001.02 Nonexempt employees means employees who are eligible to receive compensatory payment or time off for overtime.93 Neb.
