Section 92-71-006 - Selection of Hearing Officer006.01 The hearing officer shall be selected by the Director to hear a particular case either: 006.01A On a random basis, or006.01B By agreement between: 006.01B1 The Director and the individual with a disability who is the subject of the hearing; or 006.01B2 In an appropriate case, the Director and the authorized representative who may include a parent, a family member, a guardian, an advocate, or an authorized representative, of the individual.006.02 The hearing officer shall be selected from among a pool of qualified persons identified jointly by: 006.02A The division of Vocational Rehabilitation Services, Nebraska Department of Education; and, 006.02B The members of the Nebraska Rehabilitation Council established pursuant to 29 U.S.C. 721.92 Neb.
