Section 273-16-006 - POLITICAL ACTIVITIES
006.01 An employee may engage in any political activities except that an employee may not:
(A) Participate in political activities while on State time or while performing official State duties;
(B) Engage in political activity while wearing a uniform required by the State; or
(C) Use or authorize the use of State personnel, property, resources or funds for campaign purposes, unless otherwise permitted by law.
006.02 An employee whose position is funded with federal money and is covered by the federal Hatch Act is barred from being a candidate for a partisan office.
006.03 For employees covered by these rules and also covered by the Hatch Act, the federal agency responsible for administering the Hatch Act should be consulted for specific restrictions on these employees. The agency responsible for administering and investigating violations of the Hatch Act is the Office of Special Counsel.
006.04 For political activities during normally scheduled work hours, the employee needs to arrange for leave (vacation, leave without pay, etc.) to cover the period of absence.
006.05 If an employee is elected to office and such office presents a conflict of interest with the employee's job or interferes with the employee's scheduled work hours, the employing agency has authority to change the terms and conditions of employment, up to and including, termination of employment.
