Rule 42.12.208 - TEMPORARY OPERATING AUTHORITY(1) The department may grant an applicant temporary operating authority, as provided in 16-4-433, MCA. The applicant must submit an application meeting the requirements of ARM 42.12.101 and intend to operate the licensed business pending final approval.(2) Temporary operating authority will be issued for one period not to exceed 180 days.(3) If temporary operating authority has expired or been revoked, the applicant shall cease all operations and, in the case of a transfer of ownership, the licensee shall resume operations or place the license on nonuse.(4) Temporary operating authority will be immediately revoked if the applicant to whom temporary operating authority was granted, or the applicant's employees, violate any provisions of Title 16, MCA, or department rules. Such violations may affect the final decision of the department.(5) Any proposed fine, suspension, or revocation arising out of a violation will be assessed against, and is the responsibility of, the recorded owner of the license.Mont.
