Rule 4.10.317 - PERSONAL LIABILITY FOR DAMAGES(1) Nothing in these rules shall be construed to relieve any person, including landowner or applicator, from liability for damage to the person, lands, water, or other property of another, including the state of Montana, caused by the use of aquatic herbicides even though such use conforms to the rules of the department.
