Rule 37.41.315 - HOME-DELIVERED NUTRITION SERVICES, PROVIDER REQUIREMENTS
(1) Pursuant to section 336 of the Older Americans Act, 42 U.S.C. § 3030f, nutrition service providers who provide home-delivered meals shall:
(a) provide, on five or more days a week, except in a rural area where such frequency is not feasible and the department approves less frequency, at least one home-delivered meal, which may consist of hot, cold, frozen, dried, canned, or fresh foods, and, as appropriate, supplemental foods and any additional meals the provider elects to deliver;
(b) provide meals with a satisfactory storage life;
(c) provide nutrition education, nutrition counseling, and other nutrition services, as appropriate, based on the needs of meal recipients;
(d) notify appropriate officials for follow-up on any conditions or circumstances placing the older adult or the household in imminent danger;
(e) plan for availability of meals to older adults during weather-related emergencies and natural disasters, including public health emergencies; and
(f) complete at least annually an intake application for each recipient for re-evaluating the need to continue home-delivered meals.
