Rule 37.41.308 - CONGREGATE NUTRITION SERVICES, PROVIDER REQUIREMENTS
(1) The nutrition service provider shall:
(a) provide a hot or other appropriate meal in a congregate setting at least once a day, five or more days a week, except in a rural area where such frequency is not feasible and is approved by the department;
(b) provide services as close as possible in physical proximity to the majority of eligible older adults within the service area;
(c) give preference to community facilities when locating a congregate site;
(d) provide supervision of all staff working in the preparation of food, ensuring adherence to proper hygiene techniques and practices in food handling preparation and service;
(e) provide training by qualified personnel in sanitation, food preparation, and portion control for all paid and volunteer staff who prepare, handle, and serve food;
(f) conduct menu reviews at least semi-annually, ensuring compliance with ARM 37.47.306(3) when a registered dietician changes the menus;
(g) use a qualified dietician or nutritionist to conduct menu analyses;
(h) maintain menus and menu analyses for three years for auditing purposes;
(i) provide nutrition education and other nutrition services, as appropriate, based on the needs of meal recipients;
(j) plan meal availability for older adults during weather-related emergencies and natural disasters, including public health emergencies; and
(k) conduct an annual intake and nutrition risk assessment of each participant.
