Rule 37.100.139 - DISCHARGE CRITERIA(1) The provider will not discharge or transfer a resident from the AFCH without prior planning, including: (a) providing a written 30-day prior notice to the resident or resident's legal representative; and(b) maintaining a record that includes: (i) the date of discharge;(ii) the reason for discharge;(iii) the disposition of money, valuables, and medications held for safekeeping; and(iv) a forwarding address of the resident or the resident's legal representative.(2) A resident may be involuntarily discharged in less than 30 days for the following reasons: (a) the resident has a medical emergency;(b) the resident exhibits behavior that poses an immediate danger to self or others; or(c) the resident has not resided in the facility for 30 days.Mont.
