Rule 36.25.111 - COMPETITIVE BIDDING(1) All competitive bids for grazing leases or licenses shall be submitted in the form of dollars and cents per AUM. (a) A bid may not be for less than the minimum rental rate per AUM for that year determined in accordance with ARM 36.25.110. If in any succeeding year of the lease or license the amount bid is less than the minimum for that year, then the rental shall be the minimum.(b) Bids for any lease or license may only be submitted for the present reclassified use unless the bidder submits a proposed reclassified use in accordance with ARM 36.25.109.(2) Competitive bidding on agricultural leases or licenses shall be submitted based upon crop share rental. No cash bids will be accepted. In no case may the rate be less than the statutory minimum established by the Legislature for that year.(3) All competitive bid signatures must be notarized.(4) Competitive bids on a portion of a lease or license may be allowed upon approval from the department.Mont.
