Rule 10.16.3822 - TUITION RESPONSIBILITY(1) The Office of Public Instruction (OPI) is responsible for a portion of the cost of an eligible child's education when the eligible child is a Montana resident and placed in a qualifying facility, which may or may not be in the eligible child's district of residence. (2) The OPI is not responsible for any portion of the cost of a child's education if the child does not have residence in the state of Montana, except as may be specifically provided in statute. (3) If a Montana state agency, parent, or legal guardian places a child in an out-of-state school or out-of-state facility, the placing state agency, parent, or legal guardian must negotiate and fund the care and education of the child. (4) For a child placed in a qualifying facility, the tuition rate paid by the child's district of residence is calculated in accordance with 20-7-435(3)(c). MCA.
