(1) The record in the impartial due process hearing shall include: (a) all pleadings, motions, intermediate ruling;(b) all evidence received plus a stenographic record of oral proceeding;(c) a statement of matters officially noticed;(d) questions and offers of proof, objections and proceedings thereon;(e) proposed findings and exceptions;(f) findings of fact, conclusions of law and order by the impartial hearing officer.(2) Any party to a hearing has the right to obtain an audio record of the hearing. A verbatim record of the impartial due process hearing shall be taken by a certified court reporter and, upon request of either party to the hearing, transcribed. The Superintendent of Public Instruction will pay costs associated with the transcription of the record taken by the court reporter.Mont. Admin. r. 10.16.3522
