Section 2 CSR 70-30.016 - Commercial Feed LicensePURPOSE: This rule establishes the requirements for obtaining a commercial feed license.
(1) A commercial feed license is required to be obtained annually by any person or facility, section 266.165, RSMo- (A) Who manufactures a commercial feed within the state (including custom-mix or consultant-formula manufacturers);(B) Who distributes a commercial feed (includes customer-formula feeds) within or into the state (broker or jobber);(C) Whose name appears on the label as guarantor of a commercial feed; or(D) Who acts as an independent feed consultant for a fee.(2) Any person or facility who makes only retail sales of commercial feed that bears labeling or other approved indication that the commercial feed being sold is supplied by a Missouri-licensed manufacturer, distributor or guarantor who has assumed full responsibility for the payment of the tonnage inspection fee is not required to obtain a license.(3) Feed that is manufactured and consumed by the manufacturer's own livestock is not considered commercial feed and a Missouri commercial feed license is not required.(4) A license application supplied or approved by the Missouri Department of Agriculture must be completed, giving all required information and submitted to the department along with the established fee on an annual basis to obtain a commercial feed license.
