Section 11 CSR 45-15.020 - Distribution and Availability of Exclusion ListPURPOSE: This rule establishes procedures for distributing exclusion list.
(1) The commission shall maintain a list of persons to be ejected or excluded from a riverboat gaming operation. The list shall be distributed to each riverboat gaming operation which shall acknowledge receipt of the list in writing. In addition, the Class A or Class B licensee shall notify the excluded person by certified mail that s/he is no longer welcome on the premises of the riverboat gaming operation and, if discovered on the premises, after the Class A or B licensee has removed the excluded person from the river-boat gaming operation, the licensee will contact local authorities to request that the person be arrested for trespassing and, shall report the incident to the county prosecutor and request charges be filed under section 569.140, RSMo for criminal trespassing, a Class B misdemeanor. The list may also be distributed to law enforcement agencies. The following information, to the extent known, shall be provided for each excluded person: (A) The full name and all known aliases, and date of birth;(B) A physical description;(C) The effective date the person's name was placed on the list;(D) A photograph, if available;(E) The person's occupation and current home and business address; and(F) Other information as deemed necessary by the commission.
