Section 37-1-7501-09002-329 - Non-Conforming Sign A sign that was legally erected under the law and circumstances then and there existing that fails to conform to the requirements of this Rule because of subsequent changes to the law or the circumstances. Examples of nonconforming signs include but are not limited to the following:
1. A sign that is erected in a commercial or industrial zone conforming to all requisites of this Rule that fails to conform at a later date because the commercial or industrial zone has been modified by the local government unit to another classification that doesn't support outdoor advertising (residential, agricultural area, etc.);2. A sign that is erected in an unzoned commercial or industrial area conforming to all requisites of this Rule that fails to conform at a later date because the character of the area has changed to that of a residential or agricultural area; or3. A sign that is erected in a commercial or industrial area (zoned or unzoned) conforming to all requisites of this Rule that fails to conform to the spacing requirements at a later date (i.e. an interchange is built in close proximity placing it within 500 feet of a ramp).
