Section 37-1-7501-04016-104 The policy for the adjustment or relocation of utilities within the corporate limits of a municipality is as follows:
1. The municipality will make the necessary adjustments in its own facilities located within a dedicated street width which is coincident with a highway project at no cost to the Transportation Commission.2. The Transportation Commission will reimburse the municipality for relocation or adjustments of its facilities which are located within the dedicated width of the city street which is crossed by a highway project if the highway project is not coincident with a city street.3. The Transportation Commission will reimburse the municipality for relocation or adjustments of the municipalities' facilities located outside a dedicated street width, on private right-of-way, which are not located on state lands or other public right-of-way, provided the municipality has a compensable property interest.4. The municipality will relocate, or cause to be relocated, all other utilities not owned by the municipality that are located within its right-of-way at no cost to the Transportation Commission.5. The Transportation Commission will reimburse all other utility companies for the relocation or adjustments of their facilities which are not municipally owned, where the utilities are located on private right-of-way, provided the utility has a compensable property interest.37 Miss.
