In lieu of conforming to the plans of the Commission or to existing facilities as set out in Paragraph B and C above, the Drainage Districts or abutters may enter into agreements with this Commission providing for the alteration of the highway plans or existing highway facilities to accommodate the planned improvements. Any increase in project costs due to such plan change or the costs of altering existing highway facilities, including engineering costs incurred by the Commission or private engineers, will accrue to the Drainage District or to the abutter. Such agreements will provide for reimbursement for any damage to the highway or highway structures and save the Mississippi Transportation Commission and Mississippi Department of Transportation, hereinafter "Department" harmless from any claims for damages due to the improvements proposed by the Drainage Districts or abutters.
