Rule 30-2301-1.25 - BOARD REGULATION NUMBER 25-RADIOLOGY PERMITSPurpose: The 1985 Mississippi Dental Practice Act (Miss. Code Ann. § 73-9-1, et seq.) requires the Mississippi State Board of Dental Examiners to carry out the purposes and provisions of the laws pertaining to the practice of dentistry and dental hygiene in Mississippi. Section 73-9-5 of the Dental Practice Act provides that the Board may prohibit any auxiliary personnel from rendering service that it feels is not in the best interest of public welfare. It is the purpose of this Board regulation to (a) provide for the establishment of minimum standards for the issuance of permits to such persons who are found to be qualified to administer dental radiologic procedures; and (b) ensure that the administration of dental radiologic procedures by dental auxiliaries is consistent with the Board's duty to protect the interest of public welfare.
1. Dental auxiliaries who desire to use ionizing radiation procedures in dentistry must obtain a radiology permit from the Board.2. The following individuals are not required to obtain a radiology permit. A. Licensed dentists and dental hygienists andB. Dental, dental hygiene, and dental assisting students actively enrolled in a corresponding CODA-accredited program are not required to obtain a radiology permit if: (1) The student has completed the program's radiology coursework and(2) Administration of radiographs is performed only as a function of the corresponding program.3. Applicants for a radiology permit must submit the following:A. Completed application for a radiology permit;B. Payment of the application fee and first biennial renewal fee; andC. Evidence of qualifying education. Any of the following shall be considered qualifying education for a radiology permit: (1) Unlicensed graduates of a CODA-accredited dental hygiene program may submit an official transcript to the Board;(2) Dental auxiliaries graduating from a CODA-accredited dental assisting program may submit an official transcript to the Board;(3) Dental auxiliaries currently certified by the Dental Assisting National Board, Inc. (DANB) may submit a copy of the DANB certification to the Board; or(4) Completion of a Board-approved radiology seminar no more than ninety (90) days prior to submitting Board application. Board-approved radiology seminars must include the following:a. At least eight (8) hours of instruction, including both didactic and clinical components;b. Instruction on the use of traditional and digital x-ray technology and equipment;c. Evaluation of each participant's ability to successfully complete a full-mouth series of x-rays; andd. Written examination at the conclusion of the seminar.4. Renewal of radiology permits. A. The Board shall maintain records for all radiology permit holders. Each permit holder shall keep the Board advised of any change in address, telephone number, email address, or employer within thirty (30) days of such change.B. Renewal of radiology permits shall occur on a biennial basis, according to conditions outlined in Rule 1.37 - Board Regulation 37, subsection "1".C. Any permit not renewed by the deadlines set forth in Rule 1.37 -Board Regulation 37 will be voided for a failure to re-register. There shall be no reinstatement of voided radiology permits; instead, a holder of a voided radiology permit may pursue application for a new radiology permit.5. Allowance by a licensed dentist of a dental auxiliary to expose radiographs without a radiology permit shall be grounds for disciplinary action, pursuant to Miss. Code Ann. § 73-9-61.30 Miss. Code. R. 2301-1.25
