Rule 30-1001-8.6 - Conflict, Bias, and DisqualificationA. A respondent in a disciplinary proceeding may assert conflict or bias by filing with the Board at least three (3) days prior to a scheduled disciplinary hearing an affidavit asserting a conflict or bias against any member(s) of the Board, setting forth in sufficient detail factual bias for the assertion.B. A Board member shall not be entitled to participate in any disciplinary action if the Board determines such Board member is personally biased against the respondent. The recusal or disqualification of Board members shall be considered on the record as a preliminary matter at the hearing before any other questions are decided.
C. The CCC or any other member of the Board who investigates the factual basis and allegations of a complaint shall be disqualified from participating in the disciplinary action resulting from that investigation.30 Miss. Code. R. 1001-8.6
