Rule 15-5-85-3.3.4 - Rescission of acknowledgement of paternity

In those cases where the mother was not married at the time of either conception or birth, or at any time between conception and birth, and the mother and natural father acknowledge such paternity by affidavit, either the mother or the acknowledged father may rescind the acknowledgement within the earlier of one year of the date of the signature on the Acknowledgement of Paternity affidavit or the date of a judicial proceeding relating to the child, including a proceeding to establish a support order, in which the signatory is a party. This rescission rule also applies in cases where the mother and father married after the birth of the child and legitimized the child by affidavit. This rescission rule does not apply to a legitimation affidavit in cases where the mother and father were married prior to the birth of the child but the fact was not listed on the certificate of live birth.
