BEMS shall notify the certified personnel or licensed service by registered mail, the particular reason for denial or revocation/suspension of the certification or license, if requested in writing within ten (10) days of a notification receipt of a notice of revocation, non-renewal, or suspension. Upon written request of the certified personnel or licensed service, within ten (10) business days of the notification, BEMS shall fix a date not less than thirty days from the date of such service at which time the licensee shall be given an opportunity for a prompt and fair hearing before officials of the Mississippi State Department of Health. A hearing shall be held at the Mississippi State Department of Health. A hearing officer shall be appointed by the State Health Officer, and a court reporter shall transcribe the proceedings. The hearing shall be held within thirty (30) days of receipt of the request for such hearing, unless waived in writing by the certified personnel or licensed service.
The certified personnel or licensed service shall be entitled to legal representation at his or her own expense.
