Part 1230.1602 - GROUP MEMBERSHIP DETERMINATIONSA. If, after reviewing the signed notarized statement of membership in a socially and economically disadvantaged group as described in part 1230.1601, item C, the individual's claim of membership in that group is questionable, the division may require that the individual submit additional evidence that the individual is a member of the group.B. In making such a determination, the division must consider whether the person has identified as a member of the group over a significant period of time prior to applying for certification and whether the person is regarded as a member of the group by the relevant community.
