Section R. 29.5802 - EquivalencyRule 802. Sections 1.5.3 and 1.5.4 are added to the FL/CL code as follows:
1.5.3 An owner or operator may apply for a variance to the rules by applying to the bureau with a satisfactory explanation as to why compliance is not possible. The bureau may approve a variance upon finding that the variance is based on the best interests of public health, safety, welfare, and property and the environment.1.5.4 A person aggrieved by a final decision of the bureau on a request for variance may appeal to the circuit court within 21 days of the decision.Mich.
