Section R. 325.1707 - Denial of applicationsRule 207.
(1) An initial application for registration may be denied for any of the following reasons:(a) Failure of the applicant to meet the work experience, education, and character qualifications of registration.(b) Deliberately providing false or misleading information in the application package or failure to complete the application package.(c) Offering payment to a person who is registered pursuant to the provisions of the act for completing a reference letter or an affidavit.(d) Violation of sections 12701 to 12715 of the act, a rule or construction code promulgated pursuant to the act, or an order issued pursuant to the provisions of section 12709 of the act.(e) Conviction in any civil or criminal proceeding or failure to comply with a judgment or order that is issued by the court in connection with any matter related to the conduct necessary to provide the services of a well drilling contractor or pump installer.(2) When an initial or renewal application for registration is denied, the department shall give written notice of the denial to the applicant and shall state the reason for the denial. Within 30 days of the denial, the applicant may request reconsideration of the application at an informal conference and a contested case hearing before the director. A contested case hearing that is requested by the applicant shall be held pursuant to the provisions of Act No. 306 of the Public Acts of 1969, as amended, being §24.201 et seq. of the Michigan Compiled Laws.Mich.
