Section 26.21.01.06 - Termination of Lease

If a landowner terminates a permittee's lease agreement, the Department may:

A. Transfer the permit to another licensee if the landowner and the permittee consent;

B. Require the permittee to initiate reclamation within 3 months after the date that the lease is terminated or sooner if required by the mining and reclamation plan, and to complete reclamation by a certain date; or

C. Delay any action pending resolution of any outstanding appeals.
