Section 26.01.02.23 - Stipulations and AffidavitsA. Stipulations. The parties may, by stipulation, agree upon any of the facts. A stipulation, when placed in the record, may be regarded and used as evidence at the hearing. The hearing examiner may require additional evidence.B. Affidavits. An affidavit may be admitted in the discretion of the hearing examiner, for good cause shown, as evidence in place of testimony, if the matters contained in it are otherwise admissible.Md.
