Section 14.28.08.13 - Disputes

Disputes arising in the performance of the procurement contracts which are not resolved by agreement of the parties shall be decided in writing by an authorized representative of the Executive Director. The decision of the Executive Director's authorized representative is final and conclusive unless, within 10 calendar days of receipt of a copy of the decision, the contractor delivers a written appeal to the Executive Director. In connection with an appeal, the contractor shall be afforded an opportunity to be heard and to offer binding evidence in support of the contractor's position. The decision by the Executive Director is binding upon the contractor, and the contractor shall abide by the decision.
