Section 11.05.02.11 - ResponsibilityA. No permit granted by the MPA and no inspection made by it may operate to shift to it or to its officials any responsibility for the improper packing, handling, storage, stowage, movement, classification, description, marking, labeling, or placarding of hazardous materials by others at MPA port facilities. MPA's issuance of a permit, or waiver of the requirements in this chapter does not constitute a waiver of the immunities granted to the MPA under law.B. The MPA does not assume a supervisory function with respect to these operations and may not be considered by the existence of these regulations to be in control of them. However, the MPA retains the right to direct the cessation of any operation in connection with the movement of hazardous materials at MPA port facilities, if, in the opinion of its Manager, SERM or the Manager's designee, safety requires this cessation.Md.
