Section 10.54.02.10 - Allowable Administrative and Program Service CostsA. Expenditures for Nutrition Education. (1) During each federal fiscal year, a local agency shall use for nutrition education an amount equal to at least 20 percent of the administrative award set forth in §B of this regulation.(2) A local agency may not apply the cost of dietary assessments for purposes of certification and the cost of prescribing and issuing supplemental foods to the 20 percent minimum amount required to be spent on nutrition education.(3) A local agency may apply the following to the 20 percent minimum amount required to be spent on nutrition education: (a) Salary and other costs for time spent on nutrition education consultation, whether with an individual or group;(b) The cost of procuring, producing, and distributing nutrition education materials including the cost of:(iv) Food models or other teaching aids; and(v) Mailing nutrition education material to participants;(c) Salary and other costs incurred in developing the local agency's annual nutrition education plan; and(d) Other costs that can be justified by the local agency to the State agency as related to nutrition education.B. Expenditures for Administrative Costs. A local agency may incur costs for the following administrative services:(4) Fair hearings including the cost of an independent medical assessment of an appellant, when ordered by an administrative law judge.C. The Cost of Program Certification Procedures. A local agency may incur the following program certification costs: (1) Laboratory fees for tests conducted to determine whether an individual is at nutritional risk;(2) The cost of expendable medical supplies necessary to determine whether an individual is at nutritional risk;(3) The cost of medical equipment used in connection with a nutritional risk determination to take anthropometric measurements, such as scales, measuring boards, and medical equipment used for analysis to detect anemia; and(4) Salary and other costs for time spent on certification.D. Prior Approved Costs. A local agency may incur the following allowable costs only with prior approval from the State agency:(1) Data processing costs which are required by the local agency, except for those used in general management and payroll, including acquisition of automatic data processing hardware or software whether by outright purchase, retail purchase agreement, or other method of acquisition;(2) Capital expenditures over $5,000, such as the cost of facilities, equipment, including medical equipment, other capital assets, and any repairs that materially increase the value or useful life of capital assets; and(3) Management studies performed by an agency, or department other than the local agency, or those performed by an outside consultant under contract with the local agency.Md.
