Section 10.39.01.01 - DefinitionsA. In this chapter, the following terms have the meanings indicated.B. Terms Defined. (1) "Board" means the Maryland Board of Nursing.(2) "Central Repository" means the Maryland Criminal Justice Information System Central Repository of the Department of Public Safety and Correctional Services.(3) "Certificate" means a certificate issued by the Board to practice as a certified nursing assistant in this State.(4) Certified Nursing Assistant (CNA).(a) "Certified nursing assistant (CNA)" means an individual, regardless of title, who routinely performs nursing tasks delegated by a registered nurse (RN) or licensed practical nurse (LPN) for compensation.(b) "Certified nursing assistant (CNA)" does not include: (i) A medication technician; or(ii) An individual who merely provides assistance with activities of daily living unless the client's needs are such that adverse health consequences are predictable.(5) "CFR" means the Code of Federal Regulations.(6) "Criminal history records check" means the performance of both a State criminal history check by the Central Repository and a national criminal history check performed by the Federal Bureau of Investigation (FBI).(7) "Criminal history records information" means information provided by the criminal history records check regarding an applicant's criminal arrests, charges, and convictions and other dispositions of criminal charges.(8) "Geriatric nursing assistant (GNA)" means a CNA who has successfully completed the requirements for a GNA set forth in 42 CFR §§ 483.151- 483.156 and COMAR 10.07.02.39N -.42.(9) "Geriatric nursing assistant competency examination (GNA-CE)" means an examination which meets the requirements of 42 CFR §§ 483.151- 483.156 and COMAR 10.07.02.39N -.42 to determine entry level competence for a GNA.(10) "Home health aide (HHA)" means a CNA who has successfully completed the requirements for certification as an HHA set forth in: (b) COMAR 10.07.02.43 and .44; and(11) "Licensed practical nurse (LPN)" means an individual who: (a) Is licensed by the Board to practice licensed practical nursing; or(b) Has a multistate licensure privilege to practice licensed practical nursing.(12) "Maryland Geriatric Nursing Assistant Registry (MGNAR)" means the registry maintained by the State in compliance with 42 CFR § 483.156.(13) "Medication technician (MT)" means an individual who has completed the 20-hour medication administration course approved by the Board.(14) "Multistate licensure privilege" has the meaning set forth in COMAR 10.27.01.01B.(15) "Registered nurse (RN)" means an individual who: (a) Is licensed by the Board to practice registered nursing; or(b) Has a multistate licensure privilege to practice registered nursing.Md.
