Section 10.11.03.20 - Cause for Suspension or Removal and Imposition of SanctionsA. If the Department determines that a provider, vendor, agent or employee of the provider, vendor, or a person with an ownership interest in the provider or vendor has failed to comply with these regulations, or applicable federal or State laws or regulations, the Department may initiate one or more of the following actions against the responsible party: (1) Suspension from the CMS Program;(2) Withholding of payment from the CMS Program;(3) Removal from the CMS Program; and(4) Disqualification from future participation in the CMS Program, either as a provider or vendor providing services for which CMS Program payment may be claimed.B. If the Secretary of the United States Department of Health and Human Services suspends or removes a provider from participation in Medicare or Medical Assistance, the Department shall take similar action.Md.
