Section 08.04.16.03 - Public Bathing BeachesA. Swim Beach Areas may be approved by the Department of Natural Resources only if the area: (1) Meets the requirements for Public Bathing Beach areas under COMAR 26.08.09; and (2) Is located within an approved Public Bathing Beach area as defined under COMAR 26.08.09.B. Approved Swim Beach Areas Rules. (1) A person may not operate or give permission to operate a vessel of any kind within a marked Swim Beach Area, except authorized emergency and rescue vessels.(2) A person may not place or give permission to place a mooring buoy or other vessel anchoring device inside a marked Swim Beach Area.(3) Swim Beach Area Markings. (a) The area to be enforced by a Swim Beach shall be marked with U.S. Coast Guard permitted boat exclusion area markers.(b) Swim Beach Areas owned or operated by the State or other public entity may be marked by the State.(c) Swim Beach Areas operated by other entities may not be marked by the State.Md.
