Section 05.05.01.11 - Income LimitsA. The Secretary shall establish income limits for families of limited income and families of lower income and may revise the limits from time to time. The Secretary may establish different limits for different areas of the State and may establish lower limits within any area or for a particular project.B. In establishing or revising income limits under this regulation, the Secretary shall consider: (1) The total amount of family income available for housing;(2) The size of the family;(3) The cost and condition of available housing;(4) The ability of the family to compete successfully in the conventional private housing market;(5) Relevant standards and definitions of federal housing programs; and(6) Other factors that the Secretary considers relevant.C. Limits for Shared Housing. For the purpose of determining compliance with the income limits, the Department may not aggregate the income of two or more individuals or households living together in one unit if the unit is to provide a shared living unit facility, group housing, congregate housing, or temporary shelters.Md.
