Section 178-501-7-A - Alternate Procedure for Certain Loan RequestsA. In the event an individual applicant requests a loan to acquire adaptive equipment for personal, family or household use for an amount up to a certain limit adopted by the board no less than annually, and the applicant meets certain eligibility criteria adopted by the board no less than annually, the service providers, at the election of the applicant, may process the loan without a vote of the board, provided however if the service providers conclude that the application should be denied, denial of the loan application may be done only through formal board action at the next board meeting.B.Procedure1. The support services provider shall determine that the applicant is eligible in accordance with Section 4 of this rule.2. The application shall be processed in accordance with Section 5 of this rule.3. The financial services provider shall determine the applicant's eligibility for purposes of this Section 7-A in accordance with the criteria established by the board.C. A loan made pursuant to this Section 7-A shall bear interest at a rate established by the board no less than annually, and agreed to by the applicant. In no event shall the rate exceed the maximum interest rate otherwise allowable under this rule.D. The financial services provider shall prepare a commitment specifying the terms and conditions of the loan as determined by the service providers and the applicant.E. The service providers shall not process any loan pursuant to this section in the event that either service provider determines that the applicant may not meet the eligibility criteria set forth in Section 4 or this Section 7-A of the rule.F. Any applicant, may, at any time in the process, including after receipt of a commitment pursuant to this Section 7-A request that the application be considered by the board.G. All procedures and criteria not specifically set forth in this Section 7-A shall be as otherwise set forth in this rule.94- 178 C.M.R. ch. 501, § 7-A
