If a hearing is scheduled due to a request by the Contractor or due to an exercise of the Department's discretion, the Department will provide the Contractor with at least 10 days prior written notice of the date, time and place of the hearing unless waived by the Contractor. All hearings shall be adjudicatory proceedings held in accordance with the Maine Administrative Procedure Act, 5 M.R.S.A. Section9051, et seq.
