Section 219-25-1
1. This rule incorporates by reference the National Fire Protection Association Code # 1123, Code for Fireworks Display, 2006 edition.
1. The following sections of NFPA Code #1123, Code for Fireworks Display, 2006 edition, shall not be incorporated:

Section 5.1.4.6, which reads as follows: "Dwellings, buildings, and structures shall be permitted to belocated within the display site with the approval of the AHJ and the owner of the dwelling, building, or structure, provided that the dwelling, building, or structure is unoccupied during the display, or if the structure provides protection for the occupants through noncombustible or fire-resistant construction."

Table 5.1.3.1, which reads as follows: "Distances for Outdoor Aerial Shell Display Sites: MinimumSeparation Distances from Mortars to Spectators for Land or Water Displays."

Section 5.2.1.3.2, which reads as follows: "The mortars or tubes shall be angled so that any dud shells or components fall at a point approximately equal to the offset of the mortars or tubes from the otherwise required discharge point, but in the opposite direction."

Section 5.3.1, which reads as follows: "Tents shall not be located within the discharge site during the display."

Section 5.3.2, which reads as follows: "Where tents are permitted in the fallout area by the operator and AHJ, such tents shall not be occupied during the display."

2. The following sections of NFPA Code #1123, Code for Fireworks Display, 2006 edition, shall be amended to read as follows:

Section 4.1.7.3(1), which reads: "Licensed operators or designated agents of licensed companies." is being amended to read: "Licensed fireworks technician."

Section 4.1.7.3(2), which reads: "Displays under the direct control of a licensed professional fireworks display company" is being amended to read: Displays under the direct control of a licensed professional fireworks technician.
