Section 146-3-2 - Evidence of LegitimationSatisfactory evidence oflegitimation for preparing a new birth certificate shall consist of the following:
A. Marriage Certificate. A certified copy of the parents' certificate of marriage.B. Evidence of Paternity. The following shall be accepted as evidence of paternity: 1. A joint affidavit acknowledging paternity made by both parents if both parents Are living and can be located; or2. An affidavit made by the father if the mother is deceased or cannot be located; or3. An affidavit made by the mother and one of the following if the father is deceased or cannot be located: a. Evidence that a court of competent jurisdiction has made a determination of paternity;b. Evidence that the father gave written consent for his name to appear as father on the certificate of birth; orc. If neither of the above are available other documents acknowledging paternity signed by the father may be accepted at the discretion of the State Registrar.10- 146 C.M.R. ch. 3, § 2
