Section 144-225-1 - GENERAL PROVISIONS
A. Purpose. These rules require minimum operational and equipment standards for air compressors that supply compressed air used in self-contained breathing apparatus.
B. Definitions.
1. Breathing Apparatus. "Breathing Apparatus" means any breathing device, either high or low pressure which is used to sustain human life under adverse conditions.
2. Department. "Department" mans the Department of Human Services.
3. Suppliers of Compressed Air. "Suppliers of Compressed Air" means organization, agency, individual, firm, partnership or corporation that provides compressed air to be used in self-contained breathing apparatus.
C. Licensing.
1. It is unlawful for any supplier of compressed air to fill or supply any breathing apparatus with life supporting gases in the State of Maine unless licensed to do so by the Department.
2. Fire departments are exempt from the licensing requirements as long as the use of the apparatus is restricted to departmental use in fighting fires.
3. The annual license fee shall be $10.
4. All licenses issued shall expire on March 31st, of each year.
D. Variance.
1. When compliance with the provisions of these regulations would involve hardship out of proportion to the increase in health protection secured thereby, the Department may, upon consideration permit modification of these regulations.
E. Posting. These rules shall be posted conspicuously on the premises.
F. Log.
1. A log shall be maintained documenting: (1) hours of compressor operation each day of use, (2) dates and types of filter changes, (3) dates of over-haul, maintenance and oil changes, (4) results of compressed air analysis when performed, (5) name of person(s) receiving the air.
2. This log shall be available for audit by a representative of the Department or other duly authorized agencies.
