Section 481-2-2 - Duties and responsibilities of the presiding officerThe Presiding Officer at all hearings may be either the Chairperson or an alternate designated by the Board. The Presiding Officer shall preside at a hearing in a manner affording consideration of fair play and compliance with the constitutional requirements of due process. The Presiding Officer shall also have authority to:
A. Hold a conference for the simplification of issues;B. Issue subpoenas requested by the parties;C.Place witnesses under oath;D. Take action necessary to maintain order;E. Rules on motions and procedural questions arising before and during the hearing;F. Call recesses or adjourn the hearing; andG. Prescribe and enforce general rules of conduct and decorum.06- 481 C.M.R. ch. 2, § 2
