B.Criteria for designation.The following criteria for designation of mercury as a priority chemical, as set forth under 38 M.R.S.A. §1694, have been met: (1) Mercury is known to cause significant adverse health effects to the nervous system and other human organs, is classified as a reproductive toxicantand has met the criteria listed in §1693(1) and 1693-A(2) for listing as a chemical of concern and chemical of high concern respectively;(2) Mercury has been found through biomonitoring to be present in humans;(3) Mercury has been found through sampling and analysis to be present in household dust, indoor air, drinking water or elsewhere in the home environment; and(4) Mercury is present in a consumer product used or present in the home.06- 096 C.M.R. ch. 886, § 3
