Section 096-100-157 - Significant emissions increase

"Significant emissions increase" means a Major Modification which results in:

A. Any net emissions increase of a regulated pollutant excluding GHGs that would equal or exceed any of the rates listed:

B. Notwithstanding subsection (A) above, significant means any emission rate of a new major source which would construct within ten (10) kilometers of a Class I area and have an impact on such area equal to or greater than one (1) microgram per cubic meter (µg/m3) (24-hour average) for any regulated pollutant excluding GHGs.
C. Notwithstanding subsection (A) above, significant means any emission rate or any net emission rate increase associated with a major stationary source or major modification which would construct within 10 kilometers of a Class I area and have an impact on such area equal to or greater than 1 µg/m3 (24-hour average) for any regulated pollutant excluding GHGs.
D. In addition to subsection (A) above, significant means, in reference to a net emission increase or the potential of a source to emit a pollutant subject to regulation under the CAA that is not listed in subsection (A) above or regulated under Title III of the CAA, any emission rate for any regulated pollutant excluding GHGs.
